Judicial Indecision

For the month of July, The Treaty Examiner is preparing an Issue to address the dangers and pitfalls of international adjudication. The central topic of Issue 4 (Judicial Indecision) refers to the problems that arise from seeking to enforce decisions issued by courts and tribunals outside of our own jurisdiction. From enforcement of arbitral awards and foreign judgments to compliance with decisions by international courts, Issue 4 seeks to analyze and criticize the international judicial framework.

The Treaty Examiner welcomes publications from any enthusiast of international law, regardless of background, legal tradition or education, as long as the guidelines for publications are met.

Central Topics

Issue 4 (Judicial Indecision) will be composed of articles and commentaries relating to the following issues:

  • Issues of enforcement of arbitral awards under the New York Convention 1958, the ICSID Convention 1966 and analogous treaties.
  • Enforcement of interim measures in international arbitration.
  • Compliance with orders issued by international criminal tribunals, including the International Criminal Court.
  • Implementation of WTO panel and Appellate Body reports and retaliation.
  • Enforcement of decisions and recommendations by human rights courts.
  • Compliance with judgments by the International Court of Justice.
  • Enforcement of foreign judgments in the private international legal framework.
  • Transnational civil procedure and issues of jurisdiction.
  • Etc.

The Treaty Examiner also welcomes articles and commentaries relating to any other modern issue of international law of recent relevance.

Publication process

Articles and commentaries can be submitted until 29 July 2020 at the latest.

Articles and commentaries submitted to be included in Issue 4 and that are granted approval before 1 July 2020 will be scheduled to be published during the month of July. Those that are granted approval after 1 July 2020 will be published on a rolling basis.

At the end of the month, The Treaty Examiner will publish its monthly issue containing all articles and commentaries approved in July. The guidelines, procedure and the terms and conditions of publication can be found here.

Article submitted to be published in Issue 3 (World Rebuilt) will continue to be published on a rolling basis, in accordance with the call for articles for the month of June.
